6.CONSULTATION
6.1 No formal consultation has been undertaken due to the nature of the
discussions to date. If Cabinet passes the recommendations in
paragraphs 2.1.1 and 2.1.2, a full communication and consultation
strategy will be implemented to
to be fully involved in developing the schemes that result from a
settlement. Improvement schemes to emerge from the settlement will
be taken to Cabinet for consideration and further approval. As the
proposal is to dispose of open space, this also needs to be advertised
and any objections considered (see paragraph 7.2.3 below).
7.2 Legal
7.2.1 As Drapers Field is Council-owned land, Council would need
to grant a lease of the necessary parts of Drapers Field to the
ODA for the required period.
7.2.2 Under section 123 of the Local Government Act 1972 the
Council may dispose of land in any way it wishes and because
the lease will be for less than 7 years there is no obligation to
obtain best consideration.
7.2.3 Drapers Field is open space as defined by section 336 of the
Town and Country Planning Act 1990 in that it is “land used for
the purposes of public recreation”. Under section 123(2A) of
the Local Government Act 1972 any proposed disposal of
open space must first be advertised for two consecutive weeks
in a local newspaper and any objections to the proposal must
be considered.
